Rules
CONCEPT: Contestants will enter the Pepsi Stuff Music and More Sweepstakes to win prizes including
qualifying prizes and the Grand Prize
of a Panasonic Plasma Television. Contestants will become
eligible to participate in the Grand Prize Finale by participating in
preliminary qualifying contests to be held each week during the Contest Period.
SPONSORS: The Sponsors of the Pepsi Stuff Music and More Sweepstakes are Pepsi (Pepsi Bottling
Group and PepsiCo, Inc.), White’s Fresh Foods, and 96.9 WXBQ (Bristol
Broadcasting Company, Inc.).
CONTEST PERIOD: The Pepsi
Stuff Music and More Sweepstakes will
begin on March 1, 2008, and will end when a Grand Prize Winner is declared and
the Grand Prize Finale concludes (See “Grand Prize Finale” below) on March 28,
2008.
ELIGIBILITY: No purchase is necessary to enter the contest and win, and a
contestant’s odds of winning will not be improved as a result of any purchase.
The contest is open to all legal United States residents, age 18 or older, who
reside in the Greater Tri-Cities TN/VA Area. To participate in the Pepsi Stuff Music and More Sweepstakes an individual must be the holder of
a valid photo ID. Employees of Pepsi Bottling
Group (PepsiCo, Inc.), Bristol Broadcasting Company, Inc., and White’s
Fresh Foods; employees of subsidiary and affiliated companies of the foregoing
entities and their respective advertising and promotion agencies; and the
members of the immediate families or households of such individuals are not
eligible. Owners, directors, and management employees of business entities of
whatsoever nature that are engaged in the same or substantially the same types
of business as is either of the Sponsors as named above and the members of the
immediate families or households of such individuals are not eligible. Only one
member of an immediate family or household may be qualified to participate in
the Grand Prize Finale (as described below). Upon the qualifying
of one member of an immediate family or household by any of the methods by
which contestants are qualified, all other members of his/her immediate family
or household become ineligible to participate in the Pepsi Stuff Music and More Sweepstakes. Void where prohibited.
ENTRY: Eligible individuals wishing to enter the Pepsi Stuff Music and More Sweepstakes may do so in one of two ways: (1) Individuals may attend
specific pre-announced 96.9 WXBQ live remote broadcasts at White’s Fresh Foods
locations to register. Individuals may tune to WXBQ (at 96.9 mHz.) to hear
announcements detailing the locations of these live remote broadcasts.
Approximately seven such live remote broadcasts will be staged during the
Contest Period. At the conclusion of each of these selected live remote
broadcasts, one name will be drawn at random from all the entries from that
live remote broadcast. Each name drawn in this manner (subject to meeting
eligibility requirements) will instantly win the announced Qualifying Prize
(which may include an Amazon.com Gift Card, Pepsi Branded Stuff, and Pepsi
brand products) for that remote broadcast event and will become eligible for
the Finalists Drawing which will determine who competes in the Grand Prize Finale. Each person
whose name is drawn must meet all contest eligibility requirement to be
selected as a candidate to be a Finalist. If a name is drawn and that person
fails to meet eligibility requirements, additional names may be drawn until a
contestant is qualified for the Finalists Drawing. (2) Individuals may
tune to WXBQ radio (at 96.9 mHz.)
during the Contest Period for announced opportunities to participate in
Qualifying Contests. Qualifying Contests will be aired at random times between
6am and midnight on weekdays (Monday-Friday) during the Contest Period. During
each on-air Qualifying Contest, listeners will be asked to be a designated
caller on the WXBQ Listener Line (1-800-332-3697) after a specific sounder is
aired. The Designated Caller, subject to all the contest restrictions and
eligibility requirements, will instantly win the announced Qualifying Prize for
that contest event and will become eligible for the Finalists Drawing which
will determine who competes in the Grand
Prize Finale.
FINALISTS
DRAWING:
On Tuesday, March 25, 2008, the names of all contestants who have been
qualified for the Finalists Drawing (a maximum of 7 from the live remote
broadcasts and a maximum of 40 from on-air contesting) will be placed into a
container and seven names will be randomly drawn to become Finalists to compete
in the Pepsi Stuff
Music and More Sweepstakes Contest Finale.
NOTIFICATION OF
FINALISTS: First telephone calls to notify each person
who has been designated as a Finalist about particulars of the Grand Prize Finale will be
placed before March 26, 2008, at 5:00 pm. These calls will be placed to the
telephone number each contestant has supplied on his/her entry form or to the
96.9 WXBQ air personality at the time of an on-air contest. In cases where
there is no answer when a number is called, two additional attempts to reach
the party will be made. If the party being called has an answering service or
device or if a third party answers the phone, a message relaying pertinent
notification details will be left. Reasonable and diligent efforts as described
above will be made to notify each Finalist, however the Sponsors assumes no
responsibility for technical, electronic, telephone congestion, hardware,
software or network, computer or data transmission errors, malfunctions or
difficulties of any kind in communicating with individual Finalists.
CONTEST FINALE: All of the Finalists will
assemble at a White’s Fresh Foods location (location to be determined and
communicated to each of the Finalists) on Friday, March 28, 2008, at 5:00 pm, where
the Grand Prize Finale will be conducted. All Finalists must be present
at this White’s Fresh Foods location to participate in the Grand Prize
Finale. Any Finalist who has not signed in at the 96.9 WXBQ signup location
at Grand Prize Finale location before 5:15 pm eastern time on
March 28, 2008, will forfeit his/her place in the Pepsi Stuff Music and More Sweepstakes Contest Finale and will become ineligible to win any additional
prizes. The Grand Prize Finale
will begin at approximately 5:30 pm and will conclude at approximately
6:00 pm or earlier when the Grand Prize Winner has been announced.
Judges, whose decisions shall be final, will be chosen by
96.9 WXBQ to administer and referee the Grand Prize Finale. During the Grand
Prize Finale, the Finalists will participate in drawings and/or games to
determine the Grand Prize Winner and runners-up. There will be one Grand Prize
Winner and up to six runners-up. Detailed rules and instructions regarding the
drawings and/or games will be explained to the Finalists at the time of Grand
Prize Finale.
The
Finalists must follow all contest rules and the directions given to them by the
Judges at all times during the Grand Prize Finale Period. Any contestant
who breaks any of the rules or fails to follow instructions given to him/her by
the Judges will automatically be disqualified and expelled from the contest.
Finalists are prohibited from any manner of contact that would inflict bodily
harm or discomfort to other contestant or to any personnel connected with the
contest.
In
the event changes in location or time of the Grand Prize Finale become
necessary, such changes will be communicated to each Finalist via telephone in
the same manner outlined in Notification of Finalists above.
Transportation
costs and other expenses associated with attendance at the Grand Prize Finale
are solely the responsibility of the Finalists.
PRIZES: Qualifying
Prizes will be announced at the
time of each on-air qualifying contest or at each qualifying live remote
broadcast. Qualifying Prizes to be offered will include Pepsi Stuff branded
Items, music CD’s, and Pepsi brand products. Any of these Qualifying Prizes may
be offered individually or in combination for a qualifying contest. The prize
to be awarded at the Grand Prize Finale will include four Photosmart Digital
Cameras, two Zune 80 GB Digital Media Players, and one Grand Prize Panasonic
42” Plasma Television. Any item, cost or expense not specifically listed shall be solely the
responsibility of the winner
Payment
of all federal, state, and local taxes and fees associated with the acceptance
of any prize in the Pepsi Stuff Music and
More Sweepstakes is solely
the responsibility of each prizewinner. The Sponsors
reserve the right to award a prize of equal or greater value in the event the
published prize becomes damaged or unavailable; however, no transfer or
substitution of prizes by a prizewinner is permitted and non-cash prizes
may not be redeemed for cash value.
Winners
of prizes will be required to provide a valid photo ID and may be required to
sign an IRS Form W-9 or equivalent, an affidavit of eligibility, a publicity
release, and a general statement releasing the Sponsors from liability.
Noncompliance by a potential winner will result in disqualification and an alternate
winner will be selected.
The
sponsors make no representations or warranties of any kind concerning the
appearance, performance or safety of any prize awarded. The winner of any prize
shall bear all risks of loss or damage to the prize after it has been
delivered.
ODDS: Odds of winning will depend on the number of eligible entries
received at live remote broadcast locations and/or the number of contestants
participating during on-air contests.
PUBLICITY RELEASE: By participating in the Pepsi Stuff Music and More Sweepstakes, contestants consent to the use
of their names, voices, photographs or likeness for advertising or publicity
purposes related to this or similar promotions without compensation. During the
Grand Prize Finale Period, Finalist may be asked to interact live on-air
with 96.9 WXBQ air personalities.
GENERAL: By participating in the Pepsi Stuff Music and More Sweepstakes, entrants agree, on behalf of themselves, their executors, assigns and
heirs, (a) to abide by the Official Rules and the decisions of the
Sponsors/Judges as named above which shall be final in all matters relating to
the Pepsi Stuff Music and More Sweepstakes; (b) release and
hold harmless the Sponsors as named above, their parent, subsidiary and
affiliated companies and their respective directors, officers and employees
from any and all liability, claims, or actions of any kind whatsoever for
injuries, damages or losses to persons and property which may be sustained in
connection with the receipt, ownership, or use of any prize or while preparing
for, participating in, and/or traveling to any prize-related or contest-related
activity associated in any manner whatsoever with the Pepsi Stuff Music and More Sweepstakes; and (c) that none of the foregoing
entities are responsible for damaged, late, lost, incomplete, stolen,
illegible, or misdirected entries or communications.
Each prizewinner, by accepting the prize,
acknowledges that the Sponsors have neither made nor are in any manner
responsible or liable for any warranty, representation or guarantee, express or
implied, in fact or in law, relative to any prize.
Sponsors reserve the right in
their sole discretion to modify or discontinue the Pepsi Stuff
Music and More Sweepstakes at any
time with notice in the event technical or human error or other circumstance
corrupt its conduct or operation; and in the event of such cancellation to
award the prizes by an alternate method. Sponsors are not responsible for typographical or other errors in the
printing, the offering or the administration of the contest, or in the
announcement of the prize.
The
96.9 WXBQ General Contests and Prize Policies as posted on the website
for 96.9 WXBQ (www.electric949.com) are incorporated herein by reference and
shall apply where germane to the Pepsi
Stuff Music and More Sweepstakes.
